nil/negligible business during nationwide lock down for dreaded corona virus COVID-19
– Waiver of Salary& Wage payment to employees/ workmen for the locked down period else
grant subsidy from Government to comply with the same.
– Issuance of circular of “ No work no pay” for workmen for Locked Down Period.
Respected Sir,
We, PNGI Forum introduce ourselves as one of ardent employers association having an objective to help
each other for industrial as well other sectoral growth in the State to ensure generation of employment,
community development and industry academia interface.
The members of this association are mostly engaged in manufacturing of auto components of two and
four wheelers in the region of Gurgaon, Faridabad, Delhi, Bhiwadi, Noida ,Ghaziabad, Haridwar,
Mumbai, Ahmedabad, Jaipur, Ludhiana and catering to all the OEM’s in the region like Maruti, Hero,Honda etc. they also exports to overseas customers like BMW, Mercedez Benz, PSA, General Motors,
Cummins,. Ford etc. There are other manufacturers also which inter alia includes FMCG, Garment, Agro & Diary product and Pharma, some academic and industrial training centre are also member of this forum.
Your excellency , it is well known to all that even before the spread of pandemic COVID-19 , theautomobile sectors OEM ( two wheelers and four wheelers) were in deep crisis due to continuous slump
in demand worldwide and facing huge financial bleeding from the past more than one year.
After the spread of pandemic COVID-19 in the whole country the Govt has declared lockdown from 23.03.2020, which is likely to be continued till 30.04.2020, consequent upon the same all the manufacturing units have been remaining closed and there are no production& dispatch at all.It added salt to wound of all employers who have demonstrated unshakeable resolve by paying full wages & salaries of March 2020 to all their employees irrespective of their employment status. Now are
showing patience, optimism and fortitude in dealing with COVID 19 . It is needless to mention that during this uncertain period and financial crisis it would be very difficult to continue with the disbursement of salaries & wages for April, 2020 to its employees including contractual workmen even.
As per the guidelines of the Govt, as a good will gesture and to help the employees and their family in
such crisis, we have paid full wages for the month of March 2020 without any deduction and adjustment
even after incurring huge business losses due to meagre production & sales ( Mainly Exports) in March 2020, no one even retrenched or laid off.
We would like to attract your attention towards the provisions of Industrial Disputes Act, 1947 in which there is provisions of lay off in such situation of natural calamity. During lay off the
employers has been restricted to pay 50% wages as subsistence allowance. But as per the current guidelines of the Govt the layoff is also not permitted during the lock down.
It is also worthwhile to mention here that the directions by the Govt to pay wages and not to lay off during the lock down period does not come within the framework of provisions of Disaster Management ACT, 2005 and Epidemic Diseases Act, 1897 nor the same is backed by any statutory law. The scope of these
Acts/statutes empowers the Govt to make committees to frame plans to meet disasters but not to direct the employers to pay wages and restrict the lay off.
It is also pertinent to mention here that mostly all the contractual workmen are from different states and due to this pandemic COVID-19 have already left to their home towns and it will not be possible for them to come back and join their duties when the lock down is lifted by the Govt. Therefore it is requested to
issue some direction that if any workman who does not resume his duty post lockdown should be marked absent and will not be eligible for wages because if these workmen are paid wages even
after staying at home, they would never like to come back and resume their duties.
Now survival of the industries are at stake as they have already been incurring huge losses due to the sluggish market conditions of the automobile sector, and now after the declaration of lockdown the
situation has further worsen, hence for the employers it would be very difficult or even impossible to pay wages for the month of April 2020 without any revenue if the prevailing lockdown continues.. It
will be put through hardships that could even bankrupt the employers.
In this situation of crisis there are even no subsidy/waiver to the employers by the Govt. whereas, at during this global pandemic many countries in the world have given subsidy to the employers in terms of allocated packages for compensation to the employees, wage subsidy etc.
Hence we earnestly appeal before Government to grant subsidy to industries and other establishments to enable them to disburse Wages & Salaries for the locked down period as there are no business and revenue is not being generated even, what to talk about margin,
